President Biden’s speech detailing a national strategy to combat the COVID-19 pandemic introduced two executive orders and certain administrative actions that will increase mandates for vaccination in both government and private workplaces. Alston & Bird summarizes these measures and provides links to additional resources.

The Biden Administration’s Executive Order Ensuring Adequate COVID Safety Protocols for Federal Contractors, Executive Order 14402 issued September 9, 2021, applies to direct Federal prime contracts above $250,000 and all lower tier subcontracts for work performed at the project site and facilities where work is performed pertaining to covered prime contracts and subcontracts. It does not apply to Federally assisted contracts or suppliers on covered prime contracts. The EO pertains to both prime and subcontractors, irrespective of total employment, while the other Biden Administration EO on vaccination applies to all employers (Federal contractors or subcontractors or otherwise) who employ 100 or more workers. MCAA will keep you apprised on regulatory developments along this ambitious and unique regulatory schedule.

New National Service & Maintenance Agreement Effective August 1, 2021

A new six-year National Service and Maintenance Agreement has been finalized, approved and signed by the UA and MSCA/MCAA effective August 1, 2021. This Agreement will continue to play an important role in growing the HVACR market for the organized sector.  Several important modifications are included in the new Agreement, which should benefit all national signers and local UA unions. For a demanding new warehouse project with a nine-month timeline, Current Mechanical counted on Victaulic’s experienced virtual design and construction (VDC) team, fabrication services, and grooved mechanical couplings to save installation time even as its workforce was stretched thin. “With the labor shortage, I am not sure we would have been able to complete this project without using Victaulic’s fabrication services,” said Steve Lewis, project manager at Current Mechanical.

CRW Mechanical won the bid for a parking garage’s gas piping project by switching to a Milwaukee® M18™ Force Logic™ Long Throw Press Tool rather than using a traditional all-weld approach. The Press Tool saved CRW Mechanical 15 percent on the project’s labor costs, and the crew saved 125 hours—all with just one Long Throw Press Tool onsite.

Following an energy audit, McKinstry specified Uponor’s flexible Ecoflex preinsulated piping to resolve a remote Minnesota school’s longtime heating problems and save the school thousands in energy costs. Ecoflex proved easy to install, allowing workers to lay hundreds of feet of piping in just one week.

MCAA President Armand Kilijian had the honor of addressing the United Association (UA)’s 40th General Convention this week is San Diego. Armand was greeted by fully vaccinated delegates and a standing ovation as he highlighted the importance of the UA and MCAA relationship, saying “We could not be as successful as individual contractors without our UA labor partners… and trust me when I say that each of us knows that.” 

MCAA has revised the inspection section of the Aerial Lift Safety Training Video to include pre-use inspection testing tilt sensors and pothole protectors on boom and scissors lifts. The video teaches viewers how to protect themselves while working with aerial lifts, including topics such as load capacities, inspection, function testing, what to do in case of a problem, fall prevention & protection, and safe operating procedures.

Make sure your service techs have the up-to-date safety training they need to protect themselves from arc flash and electrical shock hazards while working on equipment pushing 480 volts or less. The session covers all applicable OSHA requirements, NFPA 70E provisions, best practices, and real-world accident information.

Prefabrication was just one of the ways that Olson Plumbing and Heating leveraged Viega ProPress to take on a mountain of a project: building a new visitor’s complex at the summit of Pikes Peak that met strict environmental standards … during the COVID-19 pandemic. “We prefabbed all the domestic and hydronic piping, as much as we could, to minimize labor at the top,” said Josh Crippen, superintendent at Olson. “We prefabbed our pump skids, all the water heater and boiler skids, all the waste and vent piping. As much as possible.”

MCAA’s Association Executives Council (AEC) recognized outgoing Chair Ed Kommers at the conclusion of the virtual AEC Business Meeting on July 28, 2021. Ed (MCA of Western Washington) led the AEC for two years – a full year longer than usual – during the initial stages of the COVID-19 pandemic. Under his leadership, the Council developed virtual resources to assist many local affiliates with leadership transitions during this difficult time. Thank you, Ed!

Melanie Thompson-Ott Will Join the MCAA Staff

STIHL Cut-Off Machines Safety Recall

STIHL is recalling to repair certain TS 410 and TS 420 cut-off machines manufactured between January 2021 and April 2021. In some of these machines the flywheel can break apart while the engine is running, posing a projectile hazard to the users or bystanders. If you have any of these machines, immediately discontinue use and take them to an authorized STIHL dealer for free repair.

OSHA recently released an Emergency Temporary Standard (ETS) on COVID-19 covering settings where employees provide healthcare services or healthcare support services. Contractors providing healthcare support services, such as equipment and facility maintenance, may have to comply with several provisions in the ETS. However, the standard does not apply to “well-defined hospital ambulatory care settings” where all employees are fully vaccinated, all non-employees are screened prior to entry, and people with suspected or confirmed COVID-19 are not permitted to enter those settings. Contractors whose employees are not providing healthcare support services are exempt from the ETS. However, OSHA has updated its guidelines for employers based on the most current guidance from the CDC. Employers are urged to comply with the updated guidelines.

OSHA Releases ETS on COVID-19 and Healthcare Facility Ventilation Requirements

OSHA’s recently presented Emergency Temporary Standard on COVID-19 (ETS) describes specific requirements for healthcare facility ventilation systems. The requirements apply to employers who own or control buildings or structures with an existing heating, ventilation, and air conditioning system(s) where employees provide healthcare services or healthcare support services. If your company provides HVAC services for an affected employer, the contents of the ETS ventilation provision may be helpful to you.

Depending on the application, check valves can get a bad rap. They are blamed for problems such as water hammer, vibration, reverse flow, leakage, or component wear and damage—all of which are harmful to downstream systems. However, the real cause of these problems usually stems from poor sizing and inadequate selection of the check valve for the application.

As we come together for this year’s MSCA Conference we will celebrate a year of resilience, perseverance, and hope. Our Opening Session speaker J.R. Martinez, a U.S. Army veteran who was wounded during his service, will remind us that resilience shows up in the world in many ways. The study will track trends in U.S. construction industry safety practices, and MCAA members are encouraged to participate. The survey will close on June 23, 2021.

DOL, OSHA, and other federal agencies, are working diligently to encourage COVID-19 vaccinations. OSHA does not wish to discourage workers from receiving the COVID-19 vaccination, or disincentivize employers’ vaccination efforts. As a result, OSHA will not enforce 29 CFR 1904’s recording requirements to require any employers to record worker side effects from COVID-19 vaccination through May 2022. The agency will reevaluate the agency’s position at that time to determine the best course of action moving forward.

OSHA is reviewing recent CDC guidance and will update their website accordingly. However, until those updates are completed, the agency is referring affected employers to the “CDC guidance for information on measures appropriate to protect fully vaccinated workers.” The highlights of the guidance published by the CDC follow.

A new report provides MCAA members with a mechanical industry specific look at how MCAA members are using construction technology. The report, developed by JBKnowledge, is based on the 2020 Construction Technology Report released in March.

Mask Mandates Are Falling – What Are Employers To Do?

On May 13, 2021 the CDC unexpectedly recommended that, with limited exceptions, fully vaccinated individuals can resume all indoor and outdoor activities without wearing masks or social distancing, except where required by law or workplace guidance. In response to the confusion created by differing State and Federal guidelines, Lindabury, McCormick, Estabrook & Cooper, P.C. has prepared an overview for employers so they can create policies for addressing the vaccination status of their employees.

Department of Labor Issues Cybersecurity Best Practices for ERISA-Covered Plans

ERISA-covered plans often hold millions of dollars or more in assets and maintain personal data on participants, which can make them tempting targets for cyber-criminals. Responsible plan fiduciaries have an obligation to ensure proper mitigation of cybersecurity risks. The Employee Benefits Security Administration has prepared the following best practices for use by recordkeepers and other service providers responsible for plan-related IT systems and data, and for plan fiduciaries making prudent decisions on the service providers they should hire.

The CDC recently changed its recommendations regarding the use of face coverings for fully vaccinated individuals. Under the new guidance, fully vaccinated individuals, in most cases, no longer need to wear face coverings indoors or out, or practice social distancing. However, the loosening of the agency’s COVID-19 face covering recommendations do not change affected employers’ OSHA compliance obligations. Masks and distancing are still mandatory “where required by federal, state, local, tribal, or territorial laws, rules, and regulations, including local business and workplace guidance.”

MSCA has partnered with Convoy of Hope since 2010 to deliver supplies to families in need who live in cities where the association holds its annual conference. This partnership has resulted in the donation of more than $550,000 in food, goods, labor, and equipment that benefit individuals and families nationwide. In most states employers may legally require their workers to get COVID-19 vaccinations, provided that they make reasonable accommodations for medical or religious objections. However, doing so could result in negative consequences, so there are several items your company should consider before deciding whether to require their workers to get vaccinated.

The Association of Union Constructors (TAUC)’s seventh annual study on the current state of the union construction and maintenance labor supply throughout the United States finds that many remain optimistic in spite of dipping growth projections. The study, produced in conjunction with the Construction Labor Research Council (CLRC), also shows an easing of the labor shortage.

Effective public policy advocacy and non-partisan political activities go hand-in-hand with a broader suite of association member services at MCAA. Mike Star Among Contractors Sharing Opportunities & Challenges for 2021 in ACHR News

MSCA Board of Managers Chair Mike Star is among the contractors who spoke with ACHR News about the opportunities and challenges they expect to see in 2021. He credits “having the MSCA family for brainstorming and a sounding board” with helping his company make it through the COVID-19 pandemic. In the year ahead, he expects to see an increase in major renovations, IAQ products and upgraded and remote controls.

The CDC has revised its guidelines regarding cleaning and disinfecting surfaces to prevent the spread of COVID-19. The virus that causes COVID-19 can land on surfaces, and it’s possible for people to become infected if they touch those surfaces and then touch their nose, mouth, or eyes. However, it has been determined that the risk of infection from touching a surface is low. The CDC now believes that the most reliable way to prevent infection is to regularly wash hands and use hand sanitizers.

The purpose of the week is to support the CDC’s campaign to raise awareness about the safety, effectiveness, and benefits of receiving a COVID-19 vaccine. The CDC is providing an Essential Workers COVID-19 Vaccine Toolkit to help affected employers educate their workers about COVID-19 vaccines.

Originally enacted in March 2020 as part of the CARES Act, the Employee Retention Tax Credit (ERTC) was modified and extended through 2021. Join experts from Alston & Bird On Tuesday, April 13, 2021, from 11:00 a.m. – 12:00 p.m. ET as they explore the new opportunities for employers to claim ERTCs in 2021 and some of the challenges employers may face in determining eligibility for the credits. They will also discuss recent changes to the paid employee leave provisions of the Families First Coronavirus Response Act (FFCRA) that provide additional opportunities for employer tax credits associated with FFCRA leave. MSCA’s Advanced Service Supervisors Training provides service supervisors with the high-level skills they need to improve their job performance. This interactive virtual program will be held May 10, 11, 17 and 24 from 1:00 – 3:00 p.m. EDT.

Employers should prepare for the possibility of unprogrammed and programmed COVID-19 inspections.

Sarah Galan, a junior majoring in Mechanical Engineering at Wentworth Institute of Technology, has been awarded one of the two Ferguson-Women in the Mechanical Industry Scholarships. Ferguson underwrites these scholarships, which recognize high-achieving female students working towards a degree relative to the mechanical industry.

2021 WiMI Conference Update

We have regrettably made the decision to reschedule the 2021 WiMI Conference, originally planned for June 21-23, 2021 at the JW Marriott Austin, to June 2022. We tried our best to make WiMI2021 happen, but we were just not powerful enough to fight a pandemic. Even though the state of Texas may be open, there are still some very strict gathering restrictions in place in Austin, TX and too much uncertainly remains as to what it will be like in June. Safety remains our highest priority. So mark your calendars for June 6–8, 2022 at the JW Marriott Austin when, hopefully, we will be able to meet, learn, connect, catch up, gather, kick up our heels and hug for real as we gather together as the amazing women of MCAA/MSCA.

Need Guidance On Your Electrical Safety Lockout/Tagout Program to Comply with NFPA 70E – 2021? MCAA Has What You Need

NFPA 70E is the industry consensus standard for electrical safety in the workplace. It is part of the National Electrical Codes, and it is revised by the National Fire Protection Association every three years. The most current version is NFPA 70E – 2021. Parts of the standard help us protect our service technicians from electrical shock and arc flash hazards. One of the provisions in the standard calls for affected employers to establish a lockout/tagout program that is specific to electrical safety. MCAA’s Model Lockout/Tagout Program for Electrical Safety, which addresses work on mechanical equipment pushing 480 volts or less, was recently revised to make it consistent with NFPA 70E – 2021.

MSA has issued a user safety notice to inform users of received field reports for a limited number of Latchways Standard Self-Retracting Lifelines (SRL) in which some internal bolts came loose. MSA has not received any reports of injuries associated with this condition. However, it is requesting that users perform the actions outlined in the notice.

H.R. 133 Offers Relief, Opportunities and Challenges Going into 2021

The $2.3 trillion Consolidated Appropriations Act, 2021 (H.R. 133) provides badly needed COVID economic relief, construction market stimulus and a forward-looking prospect for market recovery in public sector infrastructure investments as the pandemic recedes. In a memo to the MCAA Government Affairs Committee, Chair Jim Gaffney provided a summary digest of the items most likely to impact MCAA members and the MCAA policy agenda. The President is seeking greater individual stimulus checks, so there may be an amendment or veto, but this summary will stand for most of what will be the final result. Correction: The latest COVID relief measure signed into law Sunday does not extend the requirement that employers offer paid sick and family leave as required under the Families First Coronavirus Relief Act passed last March as erroneously reported in the MCAA summary published in the Weekly Update on December 28, 2020. The latest COVID bill extends only the availability of the refundable tax credit as under the FFCRA until the end of March 2021 for those employers voluntarily providing such paid leave after December 31, 2020. MCAA regrets the error.

The CDC recently updated its guidelines on when to quarantine following exposure to a person who has tested positive for COVID-19. The new guidelines indicate that people who have been in close contact with someone who has COVID-19, excluding people who have had COVID-19 within the past 3 months, should quarantine immediately.

MCAA/MSCA Dues for 2021

As of January 1, MCAA and MSCA dues will be 9 cents per hour. Minimum dues for 2021 will be $1,080 (9 cents x 12,000 hours) and maximum dues will be $27,000 (9 cents x 300,000 hours). Dues paid in 2021 on hours worked in 2020 will be at the 8 cents per hour rate. New 2021 dues reporting forms will be mailed in time for you to report January hours. In addition, new dues reporting forms will be on the MCAA website under the “My MCAA” menu option.

OSHA recently issued new guidance on how to use workplace ventilation systems to reduce exposures to the coronavirus, including efficiency targets for air filters and recommendations for fan use. The guidance calls for employers to install HVAC filters with minimum efficiency reporting value ratings of “13 or higher, where feasible,” and to “consider using” high-efficiency particulate air fan and filtration systems, “especially in higher-risk areas.”

As the very public debate in Congress regarding another stimulus bill rolls on, Withum wanted to share an update issued late last week by the SBA, in conjunction with the Department of Treasury. With lobbying groups, lenders, and borrowers long-since advocating for a more simple forgiveness process, specifically for smaller loans, the SBA took this into their own hands late last week, as they released a new interim final rule (“IFR”).

CMS Announces New Repayment Terms for Medicare Accelerated and Advance Payment Program Loans

The Alston & Bird Health Care Group details how changes by the Centers for Medicare & Medicaid Services to the AAP loan program delays repayment obligations for all health care providers and suppliers that received AAP loans during the COVID-19 pandemic.

The CDC recently reported that airborne transmission of SARS-CoV-2 can occur in rare cases under just the right circumstances. In most cases, the virus is transmitted from one person to another in droplet form, and occurs when affected individuals are less than six feet away from the source for 15 minutes or more. However, new research indicates that when exposure occurs in enclosed spaces, exposure time is greater than 30 minutes, and some kind of expiratory exertion is taking place, such as shouting, singing, or exercising, the virus can be transmitted in aerosol form (smaller particles suspended in air).

Sales Basecamp is where it begins for entry-level service sales personnel in the HVACR and plumbing industry. This interactive, three week virtual program will be held every Tuesday and Thursday at 2 PM EDT, starting November 3 – 19, 2020.

By using high-density polyethylene (HDPE) pipe rather than carbon steel and pairing it with Victaulic’s HDPE pipe joining system, Shoemaker Mechanical replaced a cooling tower in less time than planned, with fewer people than expected, and avoided potential weather delays. “Negligent entrustment” can stem from employees driving company-owned vehicles, their personal vehicles, or other vehicles on company business. Employers have a responsibility to know if an employee has something in his or her driving background that creates a risk to others. Negligent entrustment implies a company knew or should have known that it put an unsafe driver behind the wheel of a vehicle and allowed that employee to drive on behalf of the company. Frank Wall has joined the MCAA staff as the association’s Executive Director, Operations. Frank is no stranger to MCAA. On August 31, 2020, OSHA published a final rule revising the beryllium standard for the construction industry. Although it is exceedingly rare for the agency’s beryllium standard to affect mechanical construction employers, if there are operations on any of your jobsites where your workers could be exposed to airborne concentrations of beryllium, you will be required to comply with the standard.

Medical Screenings During COVID-19

The Cancer Treatment Centers of America (CTCA) reports more than 80,000 Americans have failed to get their proper medical screenings during this time. As a result, CTCA is seeing more late stage cancer diagnosis. Making for harder treatment protocols and potentially worse outcomes.

With the recent increase in violence in America, now is a good time to revisit MCAA’s award winning video on workplace violence prevention and protection. The principles of situational awareness presented in the video apply absolutely everywhere, regardless of whether you’re in the workplace or elsewhere.

During the height of the COVID-19 crisis in New York City in April, MCAA member Donnelly Mechanical was an integral part of converting two facilities within Queens and Brooklyn into temporary field hospitals. These hospitals were staffed with doctors and nurses from around the country who traveled to New York to help treat COVID-19 patients and to relieve the burden from the nearby, overtaxed hospitals.

The PCA announced the opening of a new Virtual Education Series today that goes beyond the typical Zoom meeting that we have become accustomed to. The seven-episode series begins September, 23 at 1 PM EDT and will feature an in-depth look at JPG Plumbing & Mechanical Services, a member contractor based in Jessup, MD.

Honeywell has issued an Immediate Stop USE Notice for certain models of Miller MightEvac and MightyLite self-retracting lifelines (SRLs) manufactured within a specific time frame. The notice only affects specifically listed models, with identified manufacturing dates or re-certification dates between October 27, 2016 and October 6, 2018. Models outside of this date range, including new units, are not affected by this notice.

As many buildings are preparing to reopen during this pandemic, the ASHRAE Epidemic Task Force has updated its reopening “Building Readiness” guidance for HVAC systems to help mitigate the transmission of SARS-CoV-2. Specific updated recommendations to the building readiness guidance include the following: Pre- and Post- Flushing Strategy, Energy Recovery Ventilation (ERV) Systems Operation, and Building Readiness Modes of Operation for the Building.

During his career, Jon was an active member of the Mechanical Contractors Association of Eastern Missouri (MCA-EMO), where he served in various leadership positions including board president. As Jon embarks on this new chapter in his life, he said, “What I am going to miss the most is all of the people I have had the privilege to work with and the customers we served over the years.”

A construction project can be a lot like an iceberg – it’s much bigger than the part you can actually see. While Texan native Rick Gopffarth (Vice President of Preconstruction; Dynamic Systems, Inc.) might not have a lot of experience with icebergs, he is certainly an expert when it comes to the unseen but critical work that takes place before breaking ground on a project. MCAA’s recently revised Guide to Steel and Copper Piping System Pressure Testing Safety includes information on pressure testing hazards, associated injuries, primary causes of pressure testing failures, general pressure testing safety, safe work practices for hydrostatic testing, and safe work practices for pneumatic testing.

Recent research indicates that individuals with mild to moderate cases of COVID-19 remain infectious no longer than 10 days after symptoms began; and individuals with severe illness or those who are severely immunocompromised remain infectious no longer than 20 days after symptoms began. Based on these findings, the CDC has made changes to their guidelines regarding discontinuing COVID-19 isolation and precautions for non-healthcare settings.

Joint Response to Critique of Groom Law Group’s Paper on Composite Plans

In a joint letter to the Congress, the national labor/management coalition responded to the Western Council of Teamsters rebuttal of the Groom Law Group paper of Composite Plans. This July 31, 2020 version of the letter contains update analysis of the 5500 filings of the median critical and declining status plans.

The GreatFutures education program will navigate students through the competition project with online instructional sessions focused on components of a real-world contracting bid. MCAA will be launching live sessions each week, available to all students, faculty advisors and MCAA members. The topics of the sessions will be taught by current MCAA industry leaders.

The mechanical contracting industry provides many career paths, and that includes the opportunity to work for an MCA local affiliated association. This summer, MCA of Chicago has two interns, Judie Prophete and Ervin Prophete. The Food and Drug Administration (FDA) is warning everyone about hand sanitizers made with methanol. The substance, which is a form of alcohol, is toxic when absorbed through the skin or ingested. Last month the FDA listed a number of hand sanitizers made by Eskbiochem that contain methanol. This month the agency is expanding that list to include sanitizers made by other companies.

OSHA recently revised its plan for enforcing safe workplace requirements concerning COVID-19. The memorandum the agency sent to its regional administrators provides instructions and guidance for handling COVID-19-related complaints, referrals, and severe illness reports. The previous COVID-19 enforcement guidance document sent to the regional administrators back in April has been rescinded.

OSHA recently sent revised enforcement guidance to it’s regional administrators regarding affected employers’ obligation to record and report work-related cases of COVID-19. The memorandum makes it clear that employers must make a good faith effort to determine whether a case of COVID-19 is work-related, and if so, record and report the illnesses if the other required recording/recording criteria also applies.
