Working closely with Jay R Smith Mfg. Inc. we strive to have best in class inventories closest to our customers as well as true manufacturing at our Montgomery, AL facility reducing lead times and controlling quality.  Mark joined Morris Group International, Inc. in 2018 as Director of Sales and Marketing for Chronomite Laboratories, Inc. Prior to joining Morris Group International Inc., Mark worked for Zurn Industries starting in 2000. While at Zurn he worked in various sales roles to include; National Sales Manager for Specification Drains, Director of Contractor Sales, and prior to his departure in 2018 he was Director of Sales. Mark has been active in MCAA since 2008 and enjoys adding value for Contractor partners. Mark has a Bachelor of Science degree in Marketing from Penn State University.

IAPMO & SPL Offer ASSE 12080 Legionella Water Safety and Management Specialist Certification Training

The International Association of Plumbing and Mechanical Officials (IAPMO), in conjunction with Special Pathogens Laboratory (SPL), will offer an interactive ASSE 12080 Legionella Water Safety and Management Specialist Certification Training. Three dates are available: June 7-9, August 23-25, and October 18-20.

SPL President Janet Stout, Ph.D., an infectious disease mircrobiologist with more than 30 years of pioneering research in Legionella, will teach the three-day course. The speakers will include David Pierre, vice president of SPL Consulting Services, and Michael Castro, MPH, SPL’s director of Healthcare Services.

Attendees will gain the requisite knowledge, understanding, and competency to serve as a member of a facilities water safety team to help protect against Legionella outbreaks and react to one appropriately should it occur. The program will focus on the development of a risk assessment analysis, and water management and sampling plan, for protection from Legionella and other waterborne pathogens. The training will also cover the codes, and the resources, understanding, and skills needed to conduct a facility risk assessment and implement a water safety and management program to reduce the risk of infections due to Legionella.

The ASSE 12080 certification exam will be administered at the end. Attendees who pass the exam will become certified as Legionella Water Safety and Management Specialists.

What to Consider Before Requiring Workers to Get COVID-19 Vaccinations

In most states employers may legally require their workers to get COVID-19 vaccinations, provided that they make reasonable accommodations for medical or religious objections. However, doing so could result in negative consequences, so there are several items your company should consider before deciding whether to require their workers to get vaccinated.

  • If your company requires a worker to get vaccinated and that worker has an adverse reaction to the vaccine, and the results of the adverse reaction meet the criteria for an OSHA recordable injury (medical treatment beyond first aid, days away from work, etc.), OSHA considers the case to be “work-related.” Employers are required to treat the case as a “recordable illness;”
  • If your company requires a worker to get vaccinated and that worker has an adverse reaction to the vaccine, in some states the case could result in a worker’s compensation claim. Be sure to check with your worker’s compensation carrier before you proceed;
  • If your company requires a worker to get vaccinated and that worker has an adverse reaction to the vaccine, and the case is not covered by worker’s compensation the employer may be subject to a lawsuit;
  • Some states may prohibit employers from mandating the vaccines; and
  • Mandating vaccines may violate local collective bargaining agreements.

Growth Projections Dip, But Many Remain Optimistic as Labor Shortage Eases, Study Finds

The Association of Union Constructors (TAUC)’s seventh annual study on the current state of the union construction and maintenance labor supply throughout the United States finds that many remain optimistic in spite of dipping growth projections. The study, produced in conjunction with the Construction Labor Research Council (CLRC), also shows an easing of the labor shortage.

A year after the COVID-19 pandemic fundamentally altered the business landscape, professionals in the union construction industry are slightly less optimistic about growth in 2021, but given the circumstances, it’s not as bad as you might expect. Another bright spot: although finding skilled and qualified craftworkers is still a challenge for contractors, fewer employers across the country reported labor shortages last year.

These are just a couple of the interesting takeaways from TAUC’s seventh annual Union Craft Labor Supply Study, based on a comprehensive survey of 1,129 industry respondents conducted in January 2021. Once again, TAUC commissioned the Construction Labor Research Council (CLRC) to conduct the survey and compile the resulting study and analysis. Contractors, building trades representatives, owner-clients, construction managers and association professionals of every size and from every geographic region weighed in and gave their perspectives, creating a truly one-of-a-kind data set.

Last year’s study occurred just prior to the advent of the COVID-19 pandemic. This year, the data reflect nearly a year of living with the pandemic. Thus, the results from last year’s study compared to this year provide a clean “before and after” look at the data.

There was strong consistency across all nine U.S. geographic regions with fewer people indicating a shortage of union craft workers in 2020 than in 2019 for every region. The largest gains (i.e., fewer reporting a shortage) were in the South Central and Northwest Regions.

And while the study also found reduced optimism regarding growth, even in the midst of a pandemic, about two-thirds of the study participants projected growth. In other words, what makes the findings about growth projections stand out is that they are not lower than they are, given the challenges the construction and service industry face: a pandemic, union craft labor shortage, increasing cost of materials, logistics challenges, etc.

Each year, the study includes a new set of custom questions as a one-time event (previous questions are rotated off). These questions focus on emerging issues or topics critical to the construction and service industries. This year’s questions focused on the funding status of union pension funds, union craft labor portability, and the impact of the pandemic.

These safety measures, which are covered in detail, include  guardrail systems, personal fall arrest systems, fall restraint systems, and floor hole covers.

Prior to Greg’s current role, he was Vice President, Global Engineering and responsible for development of BAC’s technology and product roadmaps. Greg has been active with MCAA since 2014. Greg has a Bachelor of Science in Mechanical Engineering from the University of Maryland and a Master of Finance from Loyola University. MCAA’s MEP Innovation Conference Successfully Delivers the Content Members Need to Compete in a Digital Age

It takes a lot to compete in an industry that is constantly changing. Digital tools have integrated with the entire construction process. The contractors that are integrating more of their processes with these solutions are becoming the ones best positioned to compete going forward. 

MCAA’s MEP Innovation Conference delivered contractor-based case studies to over 1,300 attendees and demonstrated how members are using these tools to thrive in today’s industry. Over three days, 32 breakout sessions, 30 roundtables and more than 100 exhibitor demonstrations, contractors learned about the arsenal of new tools designed for a digital age. Sessions focused on real-world practical applications in use by contractors. 

This year, the conference was virtual. As Jeff Miller, Director of Virtual Construction at HFI put it, “I went into the roundtable sessions thinking that it was going to be another Zoom call that I had on in the background while I worked, but when we moved to smaller breakout rooms, and all of us were asked to turn on our cameras and have a face-to-face virtual conversation, it actually felt refreshing to talk and connect with some of the same people I would have been seeing in a live conference.”

Plans are already underway on the next MEP Innovation Conference, to be held in person next January in collaboration with NECA and SMACNA. Stay tuned for additional virtual mini sessions to keep you up to speed on more innovations the rest of the year.

MCAA Is Playing A Critical Role in Multiemployer Pension Reform

Multiemployer pension reform is in the works – finally. It was a long and arduous road – and there’s more ground to cover. MCAA, together with our partners at the UA, were key and effective players in that process.

Your association has a seat at the table thanks to MCAA members’ commitment to participation in the policy development process and the political activity that goes hand-in-hand with that.

If multiemployer pension reform comes out in our favor, it will be guided in that direction by continuing MCAA participation. Your firm and our industry will be immeasurably improved as compared with what might have been with a failing multiemployer system adversely affecting all of our businesses. Together, MCAA and the UA helped avoid that catastrophe.

MCAA Member Involvement Was Responsible for Other Key Achievements

Looking back, our MCAA member involvement was directly responsible for some other key achievements and direct member benefits over recent years, including some few examples below.

  • Keeping ill-conceived accounting disclosure rules relative to pension liability off our books – and staying vigilant about a recurrence of those problems.
  • Eliminating flow-down withholding taxes on Federal projects and adding some small subcontracting bidding protections for Federal primes and subcontractors.
  • Attaining market tax incentives for green building retrofits.
  • Maintaining prevailing wage standards – key elements of industry reforms.
  • Representing you vigorously in the health policy debate.
  • Actively fighting to maintain high-quality industry apprenticeship training programs.
  • Ensuring prevailing wage and labor law reforms in the coming years strengthen MCAA members’ market share.
  • Advocating for a number of legislative and regulatory reforms to staunch the rampant abuse of worker misclassification in the construction industry.
  • Supporting government initiatives to improve government responsible contractor selection policies for prime contractors and subcontractors.
  • Gaining elimination of reverse auction procurement procedures in Federal construction contract selections.
  • Advocating for collective bargaining and ERISA preemption of state, local and Federal paid leave mandates.

MCAA Continues to Advocate for Our Industry’s Best Interests

Looking ahead, there are larger general trends and market factors that will influence the direction of public policy, including workforce demographic challenges, rapid technological developments, and environmental challenges to our society as a whole and our industry in particular.  All of these trends will have some bearing on public policy choices in Washington, DC. Our MCAA member advocacy program and political action infrastructure must be maintained so that we – MCAA members – maintain our strong position to advocate for our industry’s best interests.

Please consider your role in helping your fellow members shape our future with effective advocacy in Washington, DC. If you want to be part of your industry’s continued competitiveness:

  1. Join our efforts by going to the MCAA PAC website and completing  the prior authorization form to allow MCAA PAC to send you solicitation material.
  2. Reach out to your local affiliate Boards and ask them to do the same on your behalf.
  3. Get your local association directly involved with lawmakers and political decision makers in their home districts, where your voice is heard directly and most effectively.
