ConsensusDocs Offers Standard Contract Document for Prefabricated Construction

Prefabricated construction has been around for decades, but important contractual and legal issues have remained unaddressed in most construction contracts. The new ConsensusDocs 753 Standard Prefabricated Construction Contract provides an off-the-shelf solution that is unique to prefabricated construction.

The ConsensusDocs 753 agreement for prefabricated construction, which includes modular buildings, is between a Constructor and a Prefabricator. The agreement addresses the most common type of prefabricated construction, an off-site prefabrication of a component that is delivered and installed at the worksite.

Also addressed is application of the common law rather than the Uniform Commercial Code (UCC). In addition, industry standard definitions for prefabricator, prefabricator’s site, and a prefabricated Component are established. The agreement provides for specific provisions addressing concerns related to inspections and sensitive proprietary information and equipment involved in prefabrication.
